摘要: 纽约作为一个高度发达的全球城市，已形成一套以区划法为核心规则、以占用许可证书为关键监管抓手的建筑用途管 制体系。详细阐述该体系如何通过“分区—用途”矩阵和垂直混合分层规定构建富有弹性的用途规则框架，并通过占 用许可证书制度实现建筑全生命周期内的用途灵活变更和动态监管。在此基础上，借鉴纽约的经验，从推动用途管制 向使用方式管理延伸、建立深入到楼板层面的混合用途管理规则、构建建筑全生命周期用途监管机制、促进用途弹性 管理与土地财税制度协同等方面，为我国优化建筑用途管制提供启示。

Abstract: As a highly developed global city, New York has formed a building use control system with zoning as the core rule and Certificate of Occupancy as the key regulatory instrument. The study elaborates on how the system constructs a flexible use regulatory framework through the zoning-use matrix and vertical mixed-use regulations, and realizes the flexible use changes and dynamic supervision throughout the building lifecycle through the Certificate of Occupancy system. On this basis, drawing on the experience of New York, this paper proposed recommendations in the aspects of extending use control to usage management, establishing floor-based mixed-use rules, constructing the building lifecycle use supervision mechanism, and promoting the coordination of use flexibility management and land taxation systems, which provides valuable references for optimizing building use control in China.
